These Terms of Service (“Terms” or “Agreement”) constitute a legally binding agreement between Shaffer Foods LLC, a Pennsylvania limited liability company doing business as Eerie Coffee Company (“Eerie Coffee Company,” “we,” “us,” or “our”), and any individual or entity (“you” or “User”) who accesses or uses our website located at https://eeriecoffee.com (the “Site”), or any of our products, services, or related offerings (collectively, the “Services”).

By accessing or using the Site or any Services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use or access the Site or Services.

By using the Site or Services, you represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into this Agreement. If you are using the Site or Services on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.



3. PRODUCTS AND SERVICES
We offer specialty coffee, related merchandise, and bundled products for sale. Product availability, descriptions, and prices are subject to change without notice. We reserve the right to limit quantities or discontinue products at any time without prior notification.



4. ORDERS AND PAYMENTS
By placing an order, you agree to provide accurate and complete information. All payments must be made at the time of purchase. We accept major credit and debit cards and other payment methods displayed at checkout. All payment transactions are processed securely by third-party providers. Shaffer Foods LLC is not responsible for payment errors or issues arising from third-party processors.



5. SUBSCRIPTIONS AND AUTO-RENEWAL
If you enroll in a recurring coffee subscription, your subscription will automatically renew at the interval you selected until canceled. You authorize us to charge your chosen payment method for each renewal period unless canceled in accordance with our cancellation policy.



6. SHIPPING AND DELIVERY
We endeavor to process and ship all orders promptly. Shipping times may vary depending on destination and carrier performance. We are not responsible for shipping delays, carrier errors, or delivery failures resulting from incorrect or incomplete addresses provided by you.



7. RETURNS, REFUNDS, AND CANCELLATIONS
Due to the perishable nature of coffee products, all sales are considered final once shipped. For subscription services or bundled items, please refer to our Purchase Options Cancellation Policy. If you receive a damaged or incorrect item, contact sales@eeriecoffee.com within seven (7) days of receipt for assistance.



8. INTELLECTUAL PROPERTY RIGHTS
All trademarks, service marks, trade names, logos, and content available on the Site are the property of Shaffer Foods LLC or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHAFFER FOODS LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR RELATING TO THE USE OF OUR SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE IN QUESTION.



13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Shaffer Foods LLC and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site or violation of these Terms.



14. GOVERNING LAW AND ARBITRATION
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Erie County, Pennsylvania. Judgment on the arbitration award may be entered in any court having jurisdiction. YOU AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS ACTION.



15. CHANGES TO TERMS
We reserve the right to amend or update these Terms at any time. All revisions will be posted on this page with an updated “Last Updated” date. Your continued use of the Site constitutes acceptance of any modifications.
